Klarity Marketplace Regulations and Guidelines

Effective January 1, 2025

Introduction

By participating in the Klarity Health Marketplace, all providers agree to abide by our guidelines to ensure a safe, professional, and supportive environment. These guidelines are subject to periodic updates, and providers are expected to stay informed about any changes. Violations may result in penalties, including removal from the marketplace.

1. General Standards

Providers must maintain the highest standards of professional conduct in all interactions within the Klarity Health Marketplace. This includes honesty, transparency, respect, and compliance with all applicable laws, regulations, and Klarity Health policies.

2. Practice and Service Listing Requirements

Providers on the Klarity Health platform must meet the following criteria:

  • Licensure & Eligibility
    • Hold an active, unrestricted license (or equivalent, such as participation in a state licensure compact) for all states in which they intend to practice.
    • Must not be excluded or sanctioned by any federal or state database.
    • Drug Enforcement Administration (DEA) registration, where applicable.
    • Any applicable federal or state registration requirements must be met.
  • Business & Listing Compliance
    • Maintain an actively registered practice or business.
    • Ensure all service listings, qualifications, and fees are accurate and kept up to date.
    • Offer only services that comply with federal, state, and local healthcare regulations.
    • Supported Language: All listings must be in English, as it is the supported language of the HelloKlarity Marketplace. Listings in other languages are not permitted.
  • Insurance & Verification Requirements
    • Maintain active malpractice insurance that meets Klarity’s coverage requirements.
    • Provide identity verification through a valid government-issued ID. Valid means it is current and not otherwise expired, suspended, or inactive.
    • Collaborative Practice: Providers in restricted states must have a collaborating physician agreement or autonomous practice certificate as required by state law.
    • W-9 Form with EIN is required for payouts, EHR integration, and insurance reimbursement.

Providers are responsible for ensuring ongoing compliance with these requirements. Failure to meet or maintain these standards may result in suspension or removal from the platform.

3. Prohibited Content and Activities

Providers are strictly prohibited from engaging in or promoting the following:

  • Illegal Activities: No encouragement of illegal activities, including violence, drug misuse, fraud, or any form of abuse.
  • Inappropriate Content: Content must not contain profanity, obscenities, hate speech, threats, harassment, or name-calling.
  • Deceptive Practices: Impersonating individuals or organizations, creating misleading listings, or manipulating marketplace features is forbidden.
  • Spam: Avoid repetitive posts, text, symbols, or unnecessary links that detract from the user experience.
  • Hate Speech: Content that expresses or promotes hatred based on race, ethnicity, nationality, gender, gender identity, sexual orientation, religion, age, or disability is strictly prohibited.

4. Privacy and Confidentiality

Providers must adhere to strict privacy and confidentiality standards when handling patient information. Compliance with HIPAA and Klarity Health’s policies is required to protect patient data and ensure secure communication.

  • Secure Patient Communication: When sending emails to patients, always use BCC (Blind Carbon Copy) to protect patient privacy and prevent unauthorized disclosure of personal information.
  • Verify Patient Authorization: Before discussing a patient’s health information with family members or third parties, check the patient’s HIPAA authorization forms to confirm who is permitted to receive such information. If no authorization is on file, do not disclose any PHI (Protected Health Information).
  • Patient Information: Do not post or share publicly any private or identifiable information about patients, including names, contact details, medical records, or any information that could constitute a breach of HIPAA regulations.
  • Personal Information: Providers must not share their own private information (e.g., phone numbers, personal addresses) in public listings or profiles.
  • No Sharing of PHI via Unauthorized Channels: Patient information should only be shared through approved and secure communication channels, such as the Klarity Health platform, encrypted messaging systems, or designated secure emails.
  • HIPAA & Data Security Compliance: Providers must follow all HIPAA regulations regarding data storage, transmission, and disclosure. Any unauthorized sharing of patient data or PHI is strictly prohibited.

Failure to comply with these privacy and security policies may result in disciplinary action, including suspension or removal from the Klarity Health platform.

5. Interactions with Patients and Providers

  • Professionalism: Interactions with patients, fellow providers, and Klarity Health staff must be respectful and professional at all times.
  • Non-Harassment: Harassment, threats, or coercion of patients, providers, or staff are strictly prohibited.
  • Feedback and Disagreement: Questioning beliefs or expertise should be conducted respectfully without attacking individuals or drowning out opinions through multiple accounts.

6. Integrity in Advertising and Promotion

  • Honest Representation: Providers must not post content that misrepresents services or qualifications. All promotions must be truthful and free of misleading claims, and comply with all applicable laws and regulations.
  • Conflicts of Interest: Providers must not create, edit, or promote content related to their own practice, or those of friends, relatives, or business associates, solely for promotional purposes.
  • External Links: Links to external websites must be directly related to your practice. Links to phishing sites, malware, or unrelated promotions are strictly prohibited.

7. Review and Feedback Policy

  • Review Collection: After each appointment, patients receive a feedback survey to leave a review that appears on your provider profile and may also be prompted to be posted on third-party platforms like Reviews.io or Trustpilot.   • AI Review Analysis: AI analyzes publicly available reviews about providers online, which may be added to their provider profile.
  • Genuine Reviews: Reviews and responses must reflect honest opinions. Providers must not post compensated reviews or reviews created for promotional purposes.
  • Patient Reviews: Patients may provide reviews of provider practices. Providers must refrain from attempting to manipulate or incentivize reviews.
  • Response to Reviews: Responses to reviews must be professional and not contain defamatory, offensive, or retaliatory language.

8. Intellectual Property Rights

  • Original Content: Providers may only post content they own or have explicit permission to use. This includes text, images, and videos.
  • No Infringement: Do not post content that infringes on intellectual property rights, including copyrighted material, trademarks, patents, or trade secrets.
